Ok I lied...one more question is that even legal for a breeder to do?

I wouldn't worry to much. Not all yorkies are silky and sleek, some are cotton coated with wave to it. And some breeders don't take the extra effort to get the ears up.....You may very well have a true purebred yorkie.
Is your puppy from AKC registered parents, if so and if you're truely concerned, you can address your concerns to AKC and they'd probably suggest DNA be done on all 3.
