Another idea is if you have a place where you could put a clothes line in your yard, you can have a running lead. This will give him room to go potty and also get some fresh air, without escaping.
I am sure it is hard to give up a dog you have had for almost a year. I would be heart broken, but I would try some alternatives before giving him away.
I am certainly not trying to criticize you, but didn't you consider this, before you got the dog?

Thank you for your suggestion, yes I did read up and consider this before I got him over a year ago. When he is let out he is always on a chain or a leash when I walk him, but it is when the door opens if he is close enough he will dart out before the person can get the door closed, and away he goes, not just a couple houses away but a block in a matter of 30 sec or out in the highway. Again thank you and I will check up on the fencing you are talking about.
