Default is there anything i can do?

i bought a stud last october, i just found out he has a luxating patella. according to my vet if i bred my pup he would pass that problem to his pups. now i need to get him fixed and work on getting a new stud, a healthy one. i spent 2000 on my male and the breeder knew i was going to use him as a stud. the only way she will reimburse my money is if i give him back to her... i have just become too attached to the little guy. plus what would she do with him, he barely uses his right leg. do you think i should ask for a half refund and i will get a statement from my vet stating his condition? any other ideas? i need help, what are my rights? i didnt get a health guarentee and i could kick myself for that! pleeeeessse help me.
