I'm so sorry to hear about your family problems but glad to hear your nephew is doing better. One thing you didn't mention, do the grandparents have legal guardianship? Regardless of the situation they are in, if they do have guardianship and you just take the kids without their permission, you could get in a heap of trouble.
We have an in-ground pool and my grandkids are not allowed near the water unless I am right there watching them like a hawk. Accidents can happen in a flash, especially with a pool and even if someone is watching. It really doesn't matter what end of the pool he was in, it still could have happened.
I pray everything turns out for the best for everyone.
