Those jurists are whacked...big time.
We did have a father here that left his child by mistake. He did not routinely drop the child off at day care. The baby was in the backseat and didn't make any noise....dad was on auto pilot....drove to work, parked, and remembered the child....
too late. I have never forgotten my child, but I've operated on auto pilot while in the midst of a daily routine. To see that father's grief and pain was heartbreaking. He didn't need punishing...he lives with it the rest of his life.
