If it were me I would prefer to see the ears up before I commit. Because of the uncertainty at this age the breeder may be willing to refund your deposit if they ears aren't up but the time you are to pick up your puppy.
As a breeder, I want to make sure the new puppy parents are happy with the puppy. If a breeder take deposits at an early age they should be flexible IMO.
