Welcome to YT, this looks like a sleepy pure bred yorkie to me. A lot of puppies ears do not stand up. Shave the hair off this babies ears, hair is weight, the less weight on the ears will help them stand up, teething also may prevent the ears to be straight. Then there is always taping the ears. I would shave the hair off and see how that works for him. Puppies have scruffy hair until it starts to grow. I believe you have a pure bred yorkie baby, and he sure is a little cutie.
