As the breeder in my opinion it is your responsibility to take him back if she doesn't want him but I don't know that I would refund the money. I certainly wouldn't want him staying with her if she didn't keep up with the shots. You could always take him straight to the vet for a parvo test and if clear he should be fine to come back to your house. Most people prefer puppies at 8 weeks because they don't know better. Yorkies should be kept until 12 weeks no matter what other people think.
