With the cold weather I wouldn't be surprised if his joints are acting up. Another thing I thought about when reading your post was perhaps he is losing his vision. He doesn't see you coming up to him so he gets startled when you get close or pet him.
It's sad seeing them like that when they get older, but it's just a part of life. Seems like you did a good job with him. 13 is pretty old for a yorkie. And I agree, I would not put him through surgery at that age.
