Max always has a toy for me, ready to play. He has been this way since he was a pup. When I cannot play, I acknowledge him and tell him he will have to wait: "You have a toy for me? Not right now. Later."
I would try acknowledging and telling Scooter that he will have to wait. If he is like Max, you will have to tell him often, but he will learn to accept it without protest.
