However, just being outside is not mistreatment assuming the animal had a choice. I have a Doggy Door, and my guys come in and go out as they please. Our Dogs (mine anyway) are not stupid. If (and it has occurred) they see a threat which they can't deal with, they retreat, bark like hell, and get me to deal with the problem.

I'm hoping your doggy door goes to a fenced in yard. A dog with no collar and tag, no dog house, no fence and in the middle of the road deserves assumptions someone HAS to care about this dog whether its a stranger or not. If my dog was in the road I would hope some one would pick her up because I certainly would not want her or let her be in the road.
