I would pick him up and take him home but leave a note on the door if no one is home just saying you found a small dog in the area and where wondering if it was there's and leave your phone number. If they respond and it's theres and they come and get him and he ends up the same way as before then I would call animal control because I think the law every where is they have to have shelter, food and water.
