From what I'm reading, I think it's better for you to take the pup.
When the pup is in your hands, you can choose to either keep him or find a good home for him and take the necessary steps (neutering etc) to make sure the pup gets a good home and a good life.

I have a male yorkie and he doesn't mark in the house nor hump my girl.
It all depends on the way the pup was raised.
