You're right...If that were someone else, they would have had their child taken away and they would have been arrested!! She doesn't look frightened in that picture at all.
Also, I agree that the paparazzi go way too far sometimes! They get away with anything themselves. Did you guys watch the movie that Mel Gibson produced, "Paparazzi"? It's really good and it'll give you a bit of insight into how far some of them are willing to go to get a shot of someone.
