You are using his crate as a punishment instead of letting it be his "safe place" and there really isn't a correlation between his potty accident on the floor and his "time out" in his crate. I don't think that THAT part is going to be much help. What I would do, if I caught him having an "accident" I would tell him NO! then place him on the pad and say, POTTY! Then if he pottied on the pad praise him like crazy and even give him a treat.
