I can't imagine that the owner could possibly be aware that this might happen. It sounds like he took all necessary precautions. Just about any dog is capable of an attack if the conditions are correct. Some dogs have a bad reputation, pit bulls being one of them. They do show up on the top 10 list of most dangerous dogs, with 9 other breeds.
One question I would ask is why is a 4 year old wandering around the neighborhood unattended? He could have easily been killed by a car or abducted. Anyway you look at it this is a tragedy.
