I would not go for that. The point of impact shows that your son was well established in the lane of travel. How can you look out for someone that's going to hit you near the rear of your car?
Unless your son had just moved into that lane or something.
I would argue that - what have you got to lose? Sometimes the squeaky wheel gets the grease . . .
