The CA board of equalization paper I posted in an earlier link plainly states that any person who sells two or more dogs per year must pay sales tax. They also need seller permits. If they sell two or more dogs per year, they have to pay sales tax.
I think anyone confused about this should contact their individual state's dept of taxation for current and up to date and accurate info so they don't get nailed with penalties for misinformation.
