It is better to wait till he is min of 12 weeks if normal size. If smaller he needs to weight 2 pounds before going to his new home. That is a normal rule to better protect the puppy and so you don't get him home and end up running to your vet in the middle of the night. Also you have to realize it is winter and better to have them older before going home, so they stay with their mana and stay warm, no drafts. I know it is hard to wait, but if she is reputable she will hold on to him longer for you for no extra charge.
P.S. I noticed his ear hair is not trimmed. It will help his ears if she does trim them while he is teething, plus I think it looks better.
