In Fl. Sales contracts that say new buyer must return a dog to them is not honored by court. By law dogs are property and may be sold by the owner.
Only exception my DIL( Who is an Lawyer), mentioned was a CO-OWNed Swissy and the judge ordered the defendant to pay 1/2 of the $1,300. he sold the dog for, to the co-owner.
My contracts says the dog has to be returned to me, to be rehomed if they can not keep the dog for any reason. I also have a spay and neuter clause. I can NOT make them do either. Once I
sell them the dog it is theirs by law. Their property. I can not sue them for custody or require them to follow through with any medical procedure.
