Cancer Teen: I Want My Doggie

A Manhattan teenager suffering from cancer is charging her little Yorkshire terrier Hershe was dognapped by the girlfriend of a convicted felon - a family friend.

A $6 million Manhattan Supreme Court lawsuit accuses Gayle Fisher Worth, 60, of Tribeca, of refusing to return the pooch to Michele Klein, 15, who was diagnosed with malignant melanoma.

The suit, filed on Michele's behalf by her father, Martin Klein, says the dog is the teen's "best friend" and has "been a great comfort" to her as she battles cancer.

"Since Hershe has been taken from our family, my daughter has been crying herself to sleep while sleeping with Hershe's dog blanket," Klein of the upper East Side said in an affidavit.

The saga began Nov. 20, when Hershe was dropped off to spend a week with Ted Kohl, a construction executive who was sentenced to up to 10 years behind bars on Nov.28 for stealing millions of dollars from a construction project.

Kohl, 63, had given Hershe to Michele as a present for her 11th birthday. "Mr. Kohl is a family friend. He would watch the dog when they went on vacation," said attorney Hayley Greenberg, who represents the Kleins.

She said they left the dog with Kohl because they went to London.

"Mr. Kohl knew he was being sentenced for his criminal convictions. This was going to be the last time for him to see the dog for a few years," Greenberg said.

In court papers, Worth's lawyer concedes Kohl gave the dog to Michele - but claims the pooch was returned a month later because her building didn't allow pets.

The lawyer accused Klein of attempting to hurt Kohl "at a particularly difficult time for him."

Klein said in court papers that he knows of no apartment restrictions.

"Worth's response is beyond the pale. Michele (in particular) and my whole family have a loving relationship with Hershe. She has been an integral part of our family for nearly five years," Klein said in court papers.

Michele was photographed holding Hershe for the Palm Beach Pet Society magazine in 2003. The caption reads: "Hershe and I have so much fun living and shopping in Palm Beach and New York ... who could ask for more."

Worth refused to discuss the dog yesterday, saying only: "I hoped it wouldn't come down to this. Go talk to Mr. and Mrs. Klein, who initiated this insanity."
