Apparently, according to the article Beamers mom just linked, in Florida, the judge decides instead of the jury, and this is what may be unconstitutional. The prosecution, of course, would have to prove premeditated murder, and I don’t think so far they have done that. Here’s a chart with all the possible outcomes, and sentencing comparisons.
