Yes, a District judge in Miami has ordered a new sentencing hearing on a case because in Florida the decision by the jurors to ask for the death penalty is by the majority of the jurors. But in 2002 the US Supreme Court had ruled that the defendants are entitled to have juries decide on whether aggravating factors lead to the death penalty.
I think it would only lead to a new sentencing hearing not a new trial. Convictions will be upheld, they would only need to have a new sentencing hearing.

I'd rather see her get life in prison without possibility of parole - and let's face it if she got the death penalty it would be years before it would be carried out, as you say there would be all the appeals etc.
