I don't wear waterproof mascara, because hate that it is so difficult to remove. But, I don't currently ever have problems with non-waterproof mascara and smudges. If I ever I have, I think it has been from using more concealer and/or foundation under my eyes, or using makeup that it more oily or moisturizing. Do you use a lot of makeup on your under eye area?
Maybe try wearing just your mascara without foundation one day (even if just at home, if you can't go without foundation!) and see if you have less problems with smudging. If it is that your face makeup is quite oily, you might have the same problem with any mascara you try.
You could also try setting your foundation with a loose powder to make it less oily and that may stop the smudging. Of course, you can always try using mascara just on the top lashes too, and that will probably help.
