I am deeply sorry for your tragic loss. Rest in peace little Max.

You would probably end up having to go to court and you would have to prove negligence. You would also be at a disadvantage because I am assuming that he was a rescue and that you did not pay full price for him. I also don't think you could/should include his breeding potential as part of his valuation because it would be dishonest. No one should breed a dog that was abused for the first 2 years of his life.

Again, I am sorry for your loss. If it were me, I would be devastated, but I would understand that it was a tragic accident.
