If I'm not mistaken, confidentiality agreements keep BOTH parties from talking or authorizing some one to talk for them. At this point, if a threat has been made, I would definitely be filing charges.
As for why the poster in question has been suspended, it has more to do with violating YT rules about reopening closed posts and the language she used while it was being done. The post was deleted. Let's just say the posting wasn't exactly professional.
