I would contact the police and have them interogate him. It they are in process of separating, then this can be considered theft, I would think since she was taken and given away without your mom's permission. Maybe the police can get somewhere with him, where you can't.

I pray your mom gets her dog back. Personally I'd probably go to jail for assault if he did this to me and my dog.
