You are correct, they do agree to a certain set of rules, and this is a clear violation of what they agreed to do. This would tell me that they are not a good breeder, and I would wonder what other shortcuts they were taking in their breeding program? I would post their name on Yorkietalk, there are lots of YTCA members who read Yorkietalk. A person must be willing to give their real name as well.
