That is what I mean by jurisdictional nightmare. When I worked for LVMPD we refused to take a report unless the bank would provide something in writing stating that that the complainant was the victim. Can't take a crime report without a specific victim and you have to choose one. If the bank doesn't reimburse her, she is out the money, she is the victim. If the bank will reimburse her, they are the ones that are out the funds and they are the victim, they would have to file the report. We, then, would not take one from the individual. That was their policy. It is actually the most logical and legally sustaining one.
But every dept is different. This does point out why it should be on the bank to reimburse her... they then are the victim and they can write it off or pursue it at their whim...and keep a customer.
I work for a small dept now that is much more flexible and helpful, but when these calls come in, it is always..where was the transaction done, etc...and a lot of head shaking deciding jurisdiction.
