I am so sorry ... A German Shepherd also attacked one of my Aunt's yorkies 2 years ago, luckily our "Tacha" was badly injured but made it to full recovery .
Personally i would go talk to the owner and see if we would pay for another dog, plus all the expenses the incident has caused you.
I have seen on those "judge" shows on tv many times, similar situations and the owner of the small dog killed always won. Research and ask for supporters, gather witnesses. But first go talk to the neighbor, who knows, maybe things will go easier than you anticipate.
