I am the President of our Condo HOA and we had the same rule (strange rule I agree). When I was not the President but just on the board we changed the bylaws to add a statement that all waste needed to be cleaned up and we purchases dog stations for around the community.
This law is strictly enforced with a tiered fine of 1st offense $100.00, 2nd is $250.00 and 3rd and any beyond is $500.00 per incident. Trust me when a person is faced with a huge fine they pick up. Oh and another comment, we trust it when people report an incident, and will usually let someone off once (which is usually enough to show we mean business).
Go to your board and make a proposal, they can change the rules and probably should.
