If you follow the logic that tail docking and anything that might cause a dog pain should be banned, then most would never own another dog. I guarantee you giving birth for a dog, is much more painful than tail docking, but people are wiling to accept that pain to fulfill their own wants and desires. So, I don't understand how those that are so vehemently opposed to docking justify dog ownership, period.
At this point I do believe tail docking on a yorkie is primarily a cosmetic preference and of course the standard. And I have no problem with that....as long as it's done correctly.
