Geez, what a horror! You are SO lucky. Six years ago I was leaving a tag sale with my pup in my arms and put her down to make peeps. All of a sudden out of the bushes came this big dog. As I bent down to pick her up he quickly bit her neck. That was the end of Gina. She died within a minute. I was devastated as was my husband and 12 yr old son. The owner of the house, tag sale and dog (I assumed) was right there speechless. She said nothing.
Everytime after that when I saw a Yorkie I cried. I just didn't have the money to get another one. My older son was with me once when I saw a pup and told me about strict liability regarding a situation such as this. What do I know? After much detective work to find the darn house which was about an hour away from our home and the owners' names and address, I filed a small claim against them, hoping that dog was theirs. Luckily I was (barely) within the statute of limitations - 1 month left to go - statute is 2 yrs.
Within a short time I received a check for the price of Gina, her vet bills and a mileage allowance for the trip to and from the breeder, after I had to defend myself against the owner's claim that her dog WAS SLEEPING and we approached it, hence the bite. Imagine that! (On a side note, that does not change strict liability, even if it were true.)
Best of all, about 6 months after that, I found Katie!!
Needless to say, I'm VERY paranoid about other dogs. I'll never trust another dog when I'm with Katie. |
