IMHO, it is much easier dealing with someone you know you can trust and the contract is merely a reminder on what both buyer and seller are agreeing on.
Over my dogs, yes I would absolutely take them to court. But, you are right, the only way to ensure that your dogs and your lines are safe is to spay/neuter them before they leave. Sad, but true.
