You said the new neighbors are moving in. Are they in the process of moving, ie: there is a truck outside and they are going in and out? If so, I don't see a problem with having a dog chained to a tree - for a short period of time, in 50* weather, with water/etc. If they keep him out there for long, I'd definitely be concerned. Maybe you can keep a record of the hours he is out there/the weather/and so on for a week, then report him if you think it's the right thing to do.
