Animal Smiley 019 No Justice for Daisy - at least not yet

this is a follow up to a previous thread

Went to court today - the kennel's attorney asked for adjournment - the legal name was incorrect (they gave it to us of course). I told him the only reason we were in small claims court is that the attorney did not return any of the phone calls made to his office. He told me I had an attitude - if I had an attitude he would KNOW it! Needless to say now we have to go back on October 26th. If anyone has any suggestions I would really appreciated it.

original thread

Back in May we had to board our yorkie Daisy at Wags N Tails in Middle Island, NY while were out of town for a few days. We have used the kennel for our cocker spaniels for 7 years and felt we knew the owner pretty well. While we were away Daisy was put with a large dog and was mauled to death. It was such a tragedy and although we had her cremated I have yet to bury her as we had planned. The kennel was not only careless but when a local newstation went with questions they denied it even happened. The owner was the one who had admitted to us that he had made a big mistake. He then told my husband that he would reimburse the cost of dog as well as the cremation (how very big of him). We couldn't even think about it at that time but now 4 months later we are still waiting. It is not even a question of the money it is the fact that they were careless and even lied about when it happened. They also didn't even call to tell us - it was only when we showed up to pick the dogs up that they told us AFTER charging us boarding and grooming for all of the dogs (they later cancelled the charge - very big of them considering) !! Our whole family is devastated and I feel that they have to be held accountable.
