I may be wrong but I think its up to your Husband to show Max who is the boss, Yorkies are small and cute but they are still dogs and need to know who the pack leader is.
If Max behaves like this again I suggest your Husband be the one to remove Max from your knee and only let him back on your knee when Max behaves.
