Co-op Hounds Dog Lover

A Brooklyn co-op board is threatening to evict an elderly blind widow unless she gets rid of a 14-year-old cancer-stricken dog.

Shirley (Sue) Joven, 81, has received two legal notices demanding she choose between her modest one-bedroom home in Madison, north of Sheepshead Bay, and her daughter's Labrador retriever, Bosco, who is both ill and deaf, she said.

The daughter, Jackie Joven, moved from Texas in April with the chocolate Lab to care for her mother.

"To them, I'm breaking the law," Sue Joven said of the co-op board members. "They should have a little compassion and understand why he's here and why I need him."

"Other people have animals," added the bewildered grandmother.

The 3165 Nostrand Ave. co-op passed rules in 2000 allowing residents to keep existing pets but barring new animals.

David Ng, a lawyer representing the co-op, charged that Jackie Joven asked the board for permission to bring Bosco before coming to Brooklyn and that the request was denied.

"The daughter asked to bring her own dog in. Now she's suggesting the dog is the companion of the mother," Ng said. "It's not. It's her dog."

The Jovens vehemently denied they'd asked the board for permission before Bosco's arrival and said the dog was sick enough that they didn't believe it would survive the three-day car trip from Texas.

"He did make it," said Sue Joven, who bought an apartment in the building eight years ago. "And he is still here."

Some neighbors were disgusted by the eviction threat. "If the dog is barking or intimidating somebody, I can see, but this is unreasonable," said Brian McLasky.
