I think if anyone questions your sound judgment, they do not know you!
From what you've presented, I think you know what you're going to have to do. You cannot take the risk of something happening to your child.
It sounds as though you have tried all the obvious means of resolving the situation but I agree with one of the previous posters.
I would do this sooner rather than later.
