I am getting so sick reading these posts. I think the breeder was wrong but I think the seller is now equally wrong. You don't need to drive 5 or 6 hours one way. Amanda offered half way which could be 2.5 hours one way. Now here is Amanda who is offering to take her AND spay her and you have problems with that. In other words, if all else fails, then you'll go to Amanda?
She is being advertised for sale, more than once. If it is because of money, just say it. I just don't understand how you don't have money to spay her but you have money for a lawyer?
You have members of YT donating money for a spay. Now you are saying you can't spay her because it would make her a different dog other than what was advertised. It will cost you TONS of money for a lawyer with no guarantee of you winning or the breeder being responsible for your attorney fees.
Is this worth it, all this, while Emma remains in your home, for how long, a year, maybe more?
I think you should consider this a lesson learned and a loss of money as a teacher to you.
I can assure you, this has happened to others as well. But lawyer fees will far outweigh the price you paid for Emma. So if it is the loss of money, which you claim it is, how can you afford all this? And you can't drive half way to meet Amanda but time for lawyers. This all makes no sense to me.
Amanda, you are a sweetheart for all you offered and I don't even know you.
Is finding a local home more important than someone who truly wants her and is offering to finance the spaying herself? You don't find too many Amandas around.
I would seriously reconsider Amanda's offer. I know your involvement with Avian but you are now involved with Emma as well and just can't continue to advertise her and hope for the best. It's not realistic for Emma to remain with you, your children and your other baby. Don't think for a minute Emma doesn't feel any of this. A dog can sense things much better than we can in hiding our feelings.
What is it you REALLY want here that you don't feel you're getting.
