*sarcasm* So the OP can go to jail and get her day care license (if she has one?) taken away. If anyone hit my kid, I'd be fuming.
BUT, as I stated above, all the five year olds I know would never even think of doing such a thing. And to the OP watching through the window... that's a totally normal thing to do, especially with a five year old. If he had been younger (under 2) I would understand this happening more. When they're five, you don't have to keep your eye 24/7 as they're supposed to be old enough to do certain activities on their own. That's the age they start kindergarten.
