Oh what a disaster!

Hello all. First I want to thank everyone who responded to my first thread and welcomed me so warmly. Your comments and replys were all very comforting. Well, the plot thickens. My mom bought teddy 15 days ago. We were concerned about his ears so the breeder took $95 off the price so we could have him checked out at the vet. She also said we could have a week before she would cash the check. This was two Saturday's ago. I told my mom that Banfield Vet was open inside of Petsmart on Sunday so why doesn't she just go get him checked out there instead of waiting until Monday to go to our normal vet, seeing that we were very anxious to find out if he was OK and in good health. They said he was a perfectly healthy pup and gave her some drops for Teddy's ears. Well, yesterday she decided to continue vet care with our normal vet and to get the rest of his shots. They of course did an exam on him and said he has LUXATING PATELLA. The poor little fellow is only 5 months old and has serious problems and now so do we. In a nut shell, my mom paid $900 and had one week to get him checked out. She did the following day and Banfield misdiagnosed him. Now the check has been cashed, the breeder is not answering her phone, Teddy needs a $1400 surgery. This breeder must have known. She said she still had him at 5 months because of his personality. Someone else probably had him and returned him because of his problem. I feel so bad because I am the one who showed my mom this ad and convinced her to go to Banfield. Teddy is so sweet and we have fallen in love with him. Unfortunately money is pretty tight for both of us. We called the breeder and left her a message saying if she gave us back the $900 we would come up with the extra money to have the surgery. I asked her to please do the right thing before we contact
the AKC and take her to small claims court. Also I think Banfield vets should be responsible for making this situation right as well. If they have done their job correctly we would have known about this problem the very next day, taken him back to the breeder, gotten the check back and not been looking at paying for a $1400 surgery two weeks after meeting this little pup. What do you think? Can anybody tell us what we should do? Please let us know. Thank you. Teddy'ssister.
