Bailey's clinging to you sounds like his adjusting to the changes of your separating from your ex, how close was he to your ex? and how old is Bailey? Also he is in a new environment and he may also be tuned in to the fact that you may need him. Regarding the crate, it's too large that's why he's using the bathroom in it. It would be best to leave him in a laundry room or bathroom without crating him and leave puppy pads down for him to use along with food water and his bed.
