Most buyers will opt to keep the pup and therefore will not get the replacement of a healthy pup. (The unintended "loop hole". If the buyer has the option of keeping the pup they will more likely contact the breeder if there is a serious problem for a healthy pup and the sick pup will still be in a loving home with the ones that have fallen in love with him. I would not at all knock you for your warranty as we know, alot of breeders give no warranty at all, but I have read a lot of post on this forum and others and see that almost everytime the buyer elects to keep the sick pup, which nullifies the warranty.

That absolutely is already in my contract...they do have that option and receiving monetary compensation instead of another pup...it is further down on the health guarantee section. Given the right situation I would also be inclined to offer the buyer a second pup AND allowing them to keep the first. It would really depend on what they wanted to do. I believe in doing whatever is right for the buyer...I stand behind my pups 100% and will do whatever I have to do to make it right. The reason I even offer a replacement pup at all is because there may be someone out there that would not be able to afford the medical treatment or for other personal reasons wouldn't WANT to keep the puppy...or if sadly the puppy were to die. Then I would want that option to be there as well. I would never make someone give up a puppy that they didn't want to.

I think you are right and that IS why some breeders put that the only option is to give up the pup and get another...because they know that there is only a slight chance they will ever give it up once they are attached...and that is not right.
