I've watched lots of those shows and it seems as though if it were a verbal agreement the plaintiff has to prove there was one and the details of it. And really, unless there are witnesses I don't think it would fly. Doesn't the burden of proof fall on the plaintiff? Excuse my ignorance about the subject if it's showing. ^^; |
Your correct, the plaintiff would have the burden of proof. HOWEVER:
I think having the dog in her possession shows that there was some kind of agreement and Quicksilver brought the dog into work so I'm sure the other co-workers felt that the dog was being exchanged hands...
I really don't think court action is necessary tho', but you'll have to let us know if you end up on judge judy or alex or whatever, Quicksilver
