Question Legal Question

I need advise...we just had a company put a new roof on our house and were told they would pull the permit. Well, when we called to finalize everything we asked for a copy of it along with a copy of the warranty. They sent the warranty but no permit (guessing they never got one). Since then we've tried to call 3 times in the period of a week and they are obviously avoiding us. In the contract it doesn't specify say they'll pay for the permit but it does say "includes all taxes and fees" and since we were told verbally I'm hoping that holds up. But the problem is the contract also states we have to pay in full no more than 10 days after completion of the job or they start charging us a $50 late fee plus interest. Does anyone know if we are obligated to pay now (if we can ever get a hold of them) and then go after them later for the permit and any other fees associated with getting it after the fact or can we legally wait to pay without penalty until they provide a valid permit to us?
