Yes, tell the Breeder you will take him on the condition that you can have him examined by a vet first. If there is anything wrong with him, get an estimate of the cost to fix (if it can be fixed), and negotiate with the breeder for a reduction in the price of the dog -- as I think you have already made up your mind about taking him.
