Does the breeder offer any health guarantee?
Tell them you want to take him to your vet before you decide what you are going to do. Find out if anything is even wrong with him and, if so, how serious. That will give you a better idea of what to do next.
TLC is right, Nevada does have the puppy lemon law but I don't know if it applies to a puppy that you don't own yet. The breeder might be able to say you took this puppy knowing it had health problems. So that is something you should look into first if you are going to go that route.
I'm sorry you are going through this when you should be happy and excited about getting your new puppy.
