I would be up front with the breeder and have her look at him. Yes, it is possible for small parents to have a large puppy...but I doubt the breeder was honest about the parents true weight. You said he was getting bigger, so I assume he is not full grown...with a 3 and 5 pound sire and dam, itis unlikely they would have anything over 7.
Being CKC you realize they do not require purebred sire and dam for registration fo pups.

You can tell the breeder you want a partial refund..if she disagrees try small claims..I saw a woman sue over an oversized Yorkie and she got a refund of half.
