Just had a look at the act, so it is indeed true the only exception is if the dog is a working dog and less than 5 days old. According to the act you (person in control of the dog) and the vet can be responsible for docking its tail - unless there was a medical reason to do so.

(9) (a) makes some liable if - he shows a dog at an event to which members of the public are admitted on payment of a fee,
